The Saddle Hub offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

The Saddle Hub is referred to as “the Company” in the following legal notice.

Use of this Site

The Company, and their affiliates maintain and operate this website for use by its customers (you). By using this site, you accept and agree to these terms and conditions, and agree that your continued use of the site is subject to ongoing compliance with these terms and conditions.  Your consideration for entering into these terms and conditions is the provision of the use of the site by the Company and you acknowledge that such consideration is a valuable consideration.
The Company may amend these terms and conditions from time to time.  Your continued use of the site following any such notice will be deemed to be acceptance of such amendments.
You are solely responsible for maintaining the confidentiality of the username and password and for all activities that occur under your account.  You must notify the Company of any unauthorised use of your account or any other breach of integrity or security of the site immediately upon becoming aware of it.

Happy Horse Happy Rider Guarantee. Trial Period. Terms and Conditions

All saddles sold through The Saddle Hub include a 10 day trial to ensure both horse and rider are happy (unless specifically excluded).  To take a saddle on a trial the Purchaser must pay the full price of the saddle prior to the saddle being released.

Should the saddle not be suitable, the purchase price, less freight charges, a $30 administration fee, and merchant services fees (if applicable), will be refunded after a MAXIMUM of 10 days trial. The purchaser will be liable for the freight costs of transporting the saddle, as well as return charges if the saddle is deemed unsuitable by them, we are happy to organize the return freight for you at your cost.  Refunds will only be processed after we have received the saddle back into our care for inspection and approval.
If the saddle is deemed unsuitable by the purchaser it must be returned in the same condition as when forwarded to purchaser, this includes but is not limited to: no adjustments, no markings, all of the same mountings, tags, covers. If the saddle has incurred any damage of any kind the Purchaser will forfeit the return guarantee offered during the trial period. (photographic records of each saddle are held by The Saddle Hub)

Freight is charged at $75 one way, to most areas in Australia (excluding remote areas, WA & NT ) this fee includes insurance within Australia. It may be necessary, for very remote areas, to organize for your saddle to be shipped to an address or courier depot at a nearby town. Saddles should be promptly collected on the day of delivery – your 10 day trial period begins once the freight tracking shows the item as “delivered”. 

It is advisable to pre-book appointments with your chosen saddle fitter once you know your saddle is on the way, as there are no extensions to the 10 trial period. Saddles being returned to The Saddle Hub under these terms, must be dispatched from the purchaser no later than the 10th day from receipt of delivery.

Fees and Charges applicable

The Saddle Hub does not charge a listing fee, however we do apply a $150 fee if the saddle is removed from sale by the owner / consignor prior to sale in the first 3 months. This fee drops to $110 if the saddle is not sold after 3 months and the owner wishes to remove it from consignment.  The saddle owner / consignor is responsible for the return freight charges also ( The Saddle Hub pays the freight into stock in first instance ). These fees are to cover the professional photography, warehouse, administration and marketing expenses. 

Payment and Pricing

All of our prices are in Australian dollars (AUD) and GST (Goods and services tax) is charged.
Purchases from The Saddle Hub must be paid in full prior to goods being shipped.
Payment can be made via Credit Card (Visa and MasterCard), AfterPay, Bank Transfer (please forward screenshot for verification) and PayPal. Credit cards and PayPal will incur a non refundable merchant fee.
Order totals are calculated in and include GST in the total price.  Delivery charges are based on flat fees and will be added to your purchase at checkout.
Product prices are regularly updated when price changes are received from our suppliers.  We reserve the right to make changes to pricing at any time or amend due to human error, computer malfunction or incorrect data and reserve the right to cancel the order.

Intellectual Property

Copyright in the information and material on this web site is vested in the Company under the Copyright Act 1968 (Cth), the laws of other countries and international treaties.  The Company reserves all intellectual property and other rights in relation to the information and material on this web site.
This web site displays a number of logos, trademarks and other intellectual property.  The Company name and logo are trademarks of the Company.  Access to this web site does not constitute a licence to use or copy any logos, trademarks or other intellectual property owned by the Company, any related entity of the Company or any third party.
No logo, trade mark or other intellectual property of the Company or any related entity of the Company may be used as a hyperlink or in any other way without the Company’s express and prior written permission.
The Company disclaims any representation or association with original manufacturers of trademarked goods and does not hold itself out as having any licensing or distribution rights endorsed by those original manufacturers.  All goods are held for resale on Consignment and any representations made as to make, type, quality and condition are made for the purpose to sufficiently describe those goods.

Errors and Omissions

The Company has made all reasonable efforts to ensure that all information and products on this web site are listed or written accurately at the time of publication, but the Company provides no guarantees, warranties or undertakings that the information, pricing, discounts or other content contained on this web site is accurate, complete or up-to-date. Prices, discounts and offers are subject to change without notice.  There may be errors on this web site for which the Company apologises and disclaims all liability.

Product Descriptions

The Saddle Hub and its affiliates attempt to be as accurate as possible. However, to the full extent permissible by applicable law, The Saddle Hub do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.

Disclaimer

The Company excludes any liability for any loss, liability or damage suffered by any person as a result of the use of this web site or reliance on any information in this web site.

Dispute Resolution

Should any dispute arise out of any aspect of this agreement, the party raising the dispute must notify Saddle Hub Australia in writing within 14 days of becoming aware of the issue in dispute. In the event that the dispute is not resolved, the Parties agree to participate in a mediation of the dispute, to be mediated by a representative of the Community Justice Centre, prior to commencing any proceedings in any other jurisdiction.

Termination

This agreement is effective from your first use of the Site until terminated by either party.
You may terminate this agreement at any time by unsubscribing to all services provided by the Site and destroying all materials obtained from the Site, all related documentation and all copies and installations thereof, whether made under the terms of this agreement.
This agreement will terminate immediately without notice from the Company, if in the Company’s sole discretion, you fail to comply with any term or provision of these terms. Upon termination, you must destroy all materials obtained from the Site and unsubscribe to all services provided by the Site.

Jurisdiction

This agreement is construed according to and is governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts in and of New South Wales in relation to any dispute arising under this agreement.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
